Terms and Conditions

These Terms and Conditions govern your access to and use of the services offered by Knowledge Horizons Training and Development Services, a sole proprietorship registered under the laws of the Republic of the Philippines with DTI BN 5127028. By creating an account, enrolling in any program, or accessing the website or Learning Management System, you agree to be bound by these Terms.

If you do not agree, you must discontinue use of the platform.

1. ABOUT US

Knowledge Horizons Training and Development Services, also known as Knowledge Horizons PH, provides online training modules, live webinars, assessments, certificates, and digital learning resources designed for Filipino learners. The nature of our service and general business overview are further detailed in our company profile 

2. ELIGIBILITY

Users must be at least 13 years old to create an account or enroll in courses. Users below 18 may enroll but are treated as having the capacity to agree to these terms without the need for parental consent verification.

3. ACCOUNT REGISTRATION

Users are required to create an account before enrolling in any training.

By creating an account, you agree to the following:

  1. Your account is personal to you and must not be shared with any other individual.
  2. The name and details you provide will appear on your certificate.
  3. You are responsible for keeping your password secure at all times.
  4. You agree not to allow others to access the platform using your credentials.
  5. Any misuse of accounts, including unauthorized access, credential sharing, or attempts to bypass system restrictions, may result in suspension or termination.

Knowledge Horizons reserves the right to immediately suspend or terminate any account without prior notice if we detect unauthorized access, account sharing, impersonation, or deliberate circumvention of platform restrictions. We may also report suspected fraudulent, abusive, or unlawful activity to the appropriate authorities and cooperate with law enforcement agencies as required under Philippine law.

4. PAYMENT AND FEES

We accept payments through the following (depending on availability of the service provider):

  • GCash
  • Maya
  • Bank transfer
  • Credit and debit card
  • PayMongo as our third-party payment gateway

Payments are processed securely through PayMongo. All payments are final and nonrefundable. You are responsible for ensuring the accuracy of payment details before proceeding.

5. REFUND AND CANCELLATION

As an online training provider offering immediate access to digital content, we do not issue refunds once enrollment is completed.

This includes:

  • Mistaken enrolment
  • Change of mind
  • Failure to complete the training
  • Failure to meet device requirements
  • Unused access
  • Scheduling conflicts

Enrollment transfers to other courses are also not permitted.

Duplicate payments caused by payment gateway errors may be reviewed for correction.

6. SERVICES PROVIDED

Your enrollment may include:

  • Self-paced modules
  • Quizzes or assessments
  • Downloadable resources
  • Certificates of completion
  • Live webinars conducted via Zoom
  • Bundled programmes
  • Platform-based learning tools and features

Access duration varies depending on the course purchased. Live webinars may be recorded for internal quality control, instructor performance review, and platform improvement purposes. Recordings will not be released publicly unless explicitly announced in advance. By joining a webinar, you acknowledge that your name, voice, or participation may be captured as part of the session recording.

7. CERTIFICATES

Certificates of completion are issued only to learners who:

  1. Complete all required lessons
  2. Pass all required assessments with the required score or criteria

You acknowledge that certificates issued:

  • Are not equivalent to CHED, TESDA, PRC, or any Philippine government accreditation
  • Do not guarantee employment, promotion, or eligibility for professional licensing

8. INTELLECTUAL PROPERTY

8.1 Ownership of Course Modules

All original course modules and educational materials created and submitted by contributors become the exclusive property of Knowledge Horizons upon acceptance, in accordance with the Course Module Development Agreement.

This applies to:

  • Text
  • Videos
  • Audio
  • Graphics
  • Quizzes and assessments
  • Downloadable resources
  • Slide presentations
  • Learning activities
  • All educational content developed specifically for Knowledge Horizons

Ownership extends only to original works or materials that contributors have rights to use.

8.2 Use of Royalty-Free and Licensed Materials

Contributors may include the following in their modules, subject to correct licensing and citation:

  • Royalty-free images
  • Licensed stock media
  • Properly cited external references
  • Public domain materials

Such third-party assets remain under their original licenses and are not claimed as exclusive property of Knowledge Horizons. However, Knowledge Horizons holds a perpetual right to use the module in its final compiled form.

8.3 Rights Granted to Knowledge Horizons

Knowledge Horizons holds full rights to:

  • Use, display, reproduce, distribute, and market the module
  • Enforce protection against unauthorised copying
  • Modify the content for formatting, quality control, and platform presentation
  • Remove or update content as needed

8.4 Restrictions on Users

Users are expressly prohibited from:

  • Copying or reproducing content in any form
  • Recording videos or screens
  • Downloading materials outside intended LMS functions
  • Reuploading or distributing content
  • Using course materials for commercial or instructional purposes without written permission
  • Bypassing access controls or technical protections

Use of automated scraping tools, including AI-powered extraction technologies, is strictly prohibited. Any attempt to harvest content through AI scraping, automated crawling, bulk downloading, or similar technological means constitutes intellectual property infringement. All violations may result in termination and legal action under the Philippine Intellectual Property Code.

8.5 User-Generated Content

Any content you submit within the platform remains yours but grants Knowledge Horizons a license to store and display such content as part of platform operation.

8.6 No Transfer of Ownership to Users

Enrollment grants you a limited personal license to access content for your own learning. No ownership or copyright is transferred.

9. USER CONDUCT

You agree not to:

  • Harass other users
  • Post abusive or harmful content
  • Attempt to hack or compromise platform systems
  • Upload malware or harmful code
  • Misuse accounts or impersonate others

Further:

  • You must not use automated tools, including bots, scrapers, crawlers, or artificial intelligence systems, to extract, copy, index, or reproduce platform content
  • You must not attempt to bypass digital rights management, content protection, or access control mechanisms
  • You must not deploy any automated system that interacts with the LMS or harvests course data without explicit written permission

Knowledge Horizons may suspend or terminate accounts at its discretion.

10. THIRD-PARTY CONTENT

Some modules may include links to external resources such as YouTube or external reading materials. Live webinars use Zoom. External platforms operate under their own terms and policies.

Use of third-party sites is voluntary and at your own risk.

11. SYSTEM AVAILABILITY

We aim to keep the platform available at all times but do not guarantee uninterruption.

We are not liable for:

  • Server downtime
  • Internet issues on the user side
  • Device incompatibility
  • Data loss
  • Delays or interruptions due to maintenance
  • Disruptions caused by third party platforms

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Knowledge Horizons is not liable for:

  • Indirect or consequential damages
  • Employment decisions made by users or third parties
  • Misuse or misinterpretation of training content
  • Decisions or actions taken based on training materials
  • Technical issues, outages, or disruptions
  • Losses due to unauthorised access of your account

Your use of the platform is at your own risk. This includes any damages or losses arising from automated scraping attempts, bot attacks, or unauthorized AI-based extraction of platform data.

13. TERMINATION OF ACCESS

We reserve the right to suspend or terminate your access if you:

  • Violate these Terms
  • Commit fraud or misuse
  • Infringe intellectual property
  • Harm the platform or other users

No refunds are provided for accounts terminated due to violations. Accounts involved in AI scraping, bot usage, content harvesting, or any automated extraction of training materials may be terminated without refund. Knowledge Horizons may also preserve relevant logs and cooperate with authorities for investigation when misuse indicates possible violations of the Cybercrime Prevention Act.

14. DATA RETENTION, PLATFORM DISCONTINUATION, AND ACCOUNT DORMANCY

(In Compliance with the Philippine Data Privacy Act of 2012)

14.1 Platform Discontinuation or Cessation of Services

Knowledge Horizons Training and Development Services reserves the right, at its sole discretion, to suspend, discontinue, migrate, or permanently cease operation of its website, Learning Management System (LMS), or any portion of its services due to business decisions, regulatory requirements, force majeure events, security concerns, or technical limitations.

In the event of a planned permanent cessation of the platform, Knowledge Horizons shall observe the principles of transparency and proportionality under the Data Privacy Act and shall:

  • Provide reasonable prior notice of at least fourteen (14) calendar days to active users through their registered email address, where practicable;
  • Advise users to download and securely store their certificates of completion and permitted personal records within the notice period; and
  • Take reasonable measures to ensure orderly system shutdown consistent with data protection obligations.

After the platform shutdown date, continued access to user accounts, certificates, learning records, or stored personal data shall no longer be guaranteed.

Failure of a user to download certificates or records within the notice period shall not create any liability on the part of Knowledge Horizons.

14.2 Certificate Storage and User Responsibility

Certificates issued by Knowledge Horizons are made available for download through the LMS during the period that:

  • The user account remains active; and
  • The platform remains operational.

In accordance with the principle of proportionality, Knowledge Horizons does not commit to indefinite storage of certificates or learning records.

You acknowledge and agree that:

  • You are solely responsible for downloading, backing up, and safeguarding your certificates once issued;
  • Knowledge Horizons is not liable for loss, unavailability, or inability to retrieve certificates resulting from platform closure, account deletion, inactivity, or failure to download within a reasonable period; and
  • Certificate storage is a convenience feature and not a perpetual data retention obligation.

14.3 Dormant and Inactive Accounts

In compliance with the principle of retention limitation under the Data Privacy Act, user accounts that show no login activity, course access, or platform interaction for a continuous period of two (2) years may be classified as dormant accounts.

For dormant accounts:

  • Knowledge Horizons may, at its discretion, notify the user via the registered email address to download certificates and personal records;
  • After reasonable notice, dormant accounts may be deleted, anonymized, or archived, including associated certificates and training records; and
  • Account deletion due to dormancy shall be final and irreversible.

Knowledge Horizons shall not be liable for any loss of data, certificates, or access resulting from dormancy-related deletion conducted in accordance with lawful retention policies.

14.4 Data Retention and Secure Disposal

Knowledge Horizons collects and retains personal data only for purposes that are:

  • Declared, specified, and legitimate;
  • Necessary for the fulfillment of training services, legal obligations, and operational requirements; and
  • Proportionate to the stated purpose, in compliance with Republic Act No. 10173.

Personal data may be securely deleted, anonymized, or disposed of when:

  • The purpose for which it was collected has been fulfilled;
  • The account becomes dormant beyond the retention period;
  • The platform or service is discontinued; or
  • Retention is no longer required by law, regulation, or legitimate business necessity.

Data disposal shall be carried out using reasonable and appropriate safeguards to prevent unauthorized access, disclosure, or recovery.

14.5 No Obligation to Maintain Legacy Access or Reissue Records

To the fullest extent permitted by law, Knowledge Horizons has no obligation to:

  • Maintain discontinued platforms or legacy systems;
  • Provide alternative access to closed or retired services;
  • Reconstruct deleted records or historical data; or
  • Reissue certificates after lawful account deletion, dormancy cleanup, or platform shutdown.

Users expressly waive any claims arising from lawful data deletion or loss of access conducted in compliance with the Data Privacy Act.

14.6 Force Majeure and Data Access Limitations

Knowledge Horizons shall not be liable for failure or delay in providing access, notices, or data retrieval due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Cybersecurity incidents
  • Power or infrastructure failures
  • Government actions or regulatory directives
  • Hosting provider or third-party platform disruptions

Such events may necessitate accelerated system shutdown or data disposal consistent with data protection obligations.

15. USER RESPONSIBILITY FOR TAXES

You are solely responsible for any tax reporting or compliance related to your training expenses. Knowledge Horizons makes no guarantees regarding tax deductibility or professional credit applicability.

16. DISCLAIMER ON PROFESSIONAL OR LEGAL ADVICE

Content in courses is for educational purposes only. It is not legal, financial, medical, or professional advice. You are responsible for verifying information before applying it.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Republic of the Philippines.

All disputes shall be brought exclusively before the proper courts of Biñan City, Laguna.
